[vc_row][vc_column][vc_column_text]We <\/span>recently investigated<\/b><\/a> the <\/span>duties and responsibilities<\/b><\/a> of the employer in the event of an <\/span>accident in the workplace<\/b>. Such issue was part of a <\/span>broader topic<\/b> related to the <\/span>guarantees and duties in the field of Work Safety.<\/b> We will now explore the subject matter again by discussing the <\/span>security<\/b> positions of the employer, the manager and the person in charge<\/b> (<\/span>supervisor<\/b>).\u00a0<\/span><\/p>\n

First of all, we should remember that an <\/span>accident in the workplace<\/b> always falls within the sphere of <\/span>responsibility of a specific figure<\/b>: this will be the <\/span>supervisor<\/b> if the accident is related to the physical execution of the job; the <\/span>manager<\/b> if the accident is connected to the work management; and finally the <\/span>employer<\/b> i<\/span>f <\/span>the accident results from management decision coming from the top of the company. These three figures are all <\/span>responsible for workplace safety<\/b>, and this responsibility is \u201c<\/span>de facto<\/b>\u201d, i.e., valid even when there is no specific appointment or delegation.<\/span><\/p>\n

The <\/span>position of supervision and control<\/b> is <\/span>always a mandatory obligation for the employer<\/b>, and if they have delegated another person to apply the rules for the protection of the health and safety of the workers, <\/span>the employer will always be responsible<\/b> for ensuring that such tasks are transferred and appropriately applied.\u00a0<\/span><\/p>\n

In this sense, a <\/span>short order<\/b><\/a> issued in 2019 by the <\/span>VII Criminal Section of the <\/b>Supreme Court<\/b> provides confirmation following the <\/span>appeal lodged by an employer<\/b> who, following an accident in the workplace, defended himself by claiming to have <\/span>delegated the organizational profiles<\/b> related to safety to other company figures.\u00a0<\/span><\/p>\n

The appeal in question was <\/span>declared inadmissible<\/b> because it was based on an <\/span>unfounded reason<\/b>, since the employer is \u2013 by nature \u2013 <\/span>obliged to comply<\/b> with safety requirements and responsible for them.\u00a0<\/span><\/p>\n

The guarantees of the manager and the person in charge are based on the \u201cde facto\u201d implementation of preventive tasks\u00a0<\/span><\/h2>\n

Having clarified this, it is still vital to underline that <\/span>there are differences between the <\/b>security<\/b> position of the employer and that of the manager and supervisor<\/b>.\u00a0<\/span><\/p>\n

In terms of <\/span>Labor Criminal Law<\/b><\/a>, the <\/span>manager<\/b> is considered the figure who performs the necessary tasks to prevent accidents at work <\/span>regardless of an actual employment contract<\/b> as an executive.\u00a0<\/span><\/p>\n

On the contrary, a professional figure who \u2013 despite having a managerial contract \u2013 does not manage workers and has no executive power over the employees <\/span>cannot be considered a manager<\/b> as far as Labor Criminal Law is concerned.\u00a0<\/span><\/p>\n

We can apply the same principle to the <\/span>supervisor<\/b>, who is the figure appointed to <\/span>supervise all the activities <\/b>performed by a group of workers of whom the supervisor is in charge. This figure is responsible for <\/span>implementing all the necessary prevention and protection measures<\/b> within their specific duties and competencies. More specifically, the supervisor must <\/span>objectively supervise<\/b> the implementation of safety requirements and <\/span>subjectively monitor<\/b> compliance with the provisions by all workers.\u00a0<\/span><\/p>\n

In practical terms, the <\/span>person in charge<\/b> will supervise \u2013 for example \u2013 the use of the necessary <\/span>PPE<\/b>, implement the control and <\/span>maintenance plans on the machines<\/b>, report <\/span>non-compliance or improper behaviors<\/b> to the supervisors and check for any <\/span>unexpected risks in the workplace.<\/b> On the other hand, the <\/span>supervisor<\/b> is not responsible for adopting and <\/span>organizing preventive measures<\/b> unless this task is expressly stated in a specific proxy.<\/span><\/p>\n

As for the <\/span>manager<\/b>, they will be in charge of managing the claim attributable <\/span>to the detail of the work management <\/b>\u2013 as mentioned at the beginning of this article and as expressly indicated by the <\/span>Criminal Court of Cassation, Section 4, August 2016, n.33630<\/b><\/a>.\u00a0 <\/span>[\/vc_column_text][\/vc_column][\/vc_row]\n<\/div>","protected":false},"excerpt":{"rendered":"
